1. Agreement to Terms & Eligibility
Welcome to Manifest & Affirmations (the "Application" or "Service"), operated by Manifest & Affirmations Inc. ("Company", "we", "us", or "our").
By downloading, installing, accessing, or using Manifest, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all terms and conditions, you must not access or use the Application.
You must be at least 13 years old (or the age of legal majority in your jurisdiction) to use our Service.
2. Description of Services
Manifest provides a digital mindfulness platform featuring:
- Curated positive affirmation card decks across diverse life categories.
- Sacred psychoacoustic soundscapes tuned to Solfeggio frequencies (e.g., 432Hz, 528Hz).
- Spoken neural voice affirmation recordings for subconscious priming.
- iOS and Android lock screen, dynamic island, and home screen widgets.
- Interactive mindset mentorship through our AI Manifestation Coach ("Aura").
3. Manifest VIP Subscriptions, Free Trials & Billing Disclosures
Certain advanced features of Manifest require a paid subscription ("Manifest VIP") or a one-time lifetime license.
- Payment: Payment will be charged to your Apple ID Account (or Google Play Account) at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal Billing: Your account will be charged for renewal within 24 hours prior to the conclusion of the current subscription period at the cost of the chosen package.
- Managing Subscriptions: You can manage or disable auto-renewal anytime in your device settings: Settings > [Your Apple ID Name] > Subscriptions.
- Free Trial Terms: If offered a free trial, any unused portion of the trial period will be forfeited when purchasing a subscription.
All refund requests for iOS purchases are governed exclusively by Apple's refund policies. To request a refund, please visit reportaproblem.apple.com.
4. Wellness, Medical & Mental Health Disclaimer
MANIFEST IS NOT A MEDICAL PROVIDER.
Our Application is not designed to diagnose, treat, cure, or prevent any mental illness, depression, anxiety disorder, or physical health condition. You should never disregard professional medical or psychiatric advice or delay seeking treatment because of content experienced within Manifest.
5. AI Manifestation Coach Disclaimer
Interactions with the AI Manifestation Coach ("Aura") are generated by advanced language models designed to provide positive cognitive reframing and motivational mantras:
- AI responses do not constitute professional psychological counseling, therapy, life coaching, or financial advice.
- Manifest does not guarantee specific manifestation outcomes, financial wealth, or relationship achievements. Manifestation is an internal personal practice.
6. User Conduct & Limited License
We grant you a non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes on your personal devices.
You agree not to:
- Decompile, disassemble, reverse engineer, or attempt to extract source code from the Application.
- Distribute, broadcast, or commercialize the original audio soundscapes or proprietary voice files.
- Use the AI Coach to generate abusive, unlawful, harassing, or harmful prompts.
7. Intellectual Property Rights
All software code, visual designs, 3D lotus emblems, color schemes, typography compositions, binaural sound recordings, and proprietary affirmation databases are the exclusive intellectual property of Manifest & Affirmations Inc. and are protected by international copyright, trademark, and trade dress laws.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Manifest & Affirmations Inc., its officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or personal goodwill, arising out of your access to or inability to use the Application.
9. Termination
We reserve the right to suspend or terminate your access to the Application at our discretion, without prior notice, if you breach any provision of these Terms.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California and applicable federal laws of the United States, without regard to its conflict of law principles.
Any disputes arising under these Terms shall be resolved via binding individual arbitration or small claims court, waiving participation in class action lawsuits.
